This Indenture made the 29th day of February in the year of Our Lord One Thousand Seven Hundred Ninety four Between Christopher WEAVER and Mary his wife of Berkey County and State of Virginia of the one part and John WEAVER of the County and State aforesaid of the other part.

WITNESSETH that for and in consideration of the sum of Fifty eight pounds current money to the said Christopher WEAVER in hand paid by the said John WEAVER at or before the Sealing and Delivering of these presents the receipt whereof is hereby acknowledged and DOTH acquit and discharge the said John WEAVER and Mary his wife, HATH granted bargained sold and confirmed and by these presents DOTH grant bargain sell and confirm unto the said John Weaver his heirs and assigns all that tract of land situate lying and being in the county aforesaid lying and being on the East side of Sleepy Creek granted to William CHAPMAN by deed from under the hand of the Right Honorable Thomas Lord FAIRFAX bearing date the 12th day of March A.D. 1777, then sold by the said William CHAPMAN to Christopher WEAVER by deed bearing the date the 16th day of February 1789 then devised by the said Christopher WEAVER by his last will and testament to his son Christopher WEAVER which is the above mentioned, and bounded as follows, BEGINNING at a chestnut stake beyond the East bank of Sleepy Creek at the Butt of a tree said to be a cornered oak to William PAUL's 218 acre Patent extending thence along a course of the line of the same So 46 Et 34 poles to the said Creek and the course continuing in the water down the Creek forty seven poles to the opposite bank with a great__6__ of the same and the course continued one hundred and nineteen poles to a place where Paul's supposed line should have been and the course continuing fifty poles to a large chesnut and a chesnut oak on a ridge on the No side of Sleepy Creek Mountain thence So 46 E 62 poles to a double bodied white oak and single white oak at the head of a small hollow in a line supposed to be Matthias SWIM's 159 acre Patent then along the line So 89 Wt 80 poles to a white oak and a black oak and a pine on the High side of a ridge in said line then leaving the same patent and along the High Hills of the Creek So Wt Seventy poles to two black oaks and a white oak then N 29 Et 29 poles to a pine then No 43 Wt 50 poles to a white oak and a black oak on the East bank of the said Creek then along the several courses and meanders of the same down the creek joining the bank thereof No 38 E 82 poles No 67 Wt 80 poles No 85 Et 96 poles and crossing the creek and the course continuing four poles to the beginning containing one hundred forty seven acres and all the buildings houses orchards ways water water courses profits hereditament and appurtenances thereunto belonging or in any wise thereunto appertaining and also all the Estate right title use property claim and demand whatsoever of the said Christopher WEAVER and Mary his wife of in and to the said premises TO HAVE AND TO HOLD the lands hereby granted and all and singular the premises hereby granted and every part and parcel thereof with the appurtances unto the said John WEAVER his Heirs and assigns forever to the only proper use and behoof of them the said John WEAVER his Heirs and assigns forever and the said Christopher WEAVER and Mary his wife for them selves and their heirs executors administrators and every of them doth covenant promise and agree with the said John WEAVER to warrant and forever defend the land and premises with all their appurtances thereunto belonging or in anywise deemed as members or part thereof to him the said John WEAVER and his Heirs and assigns free and clear from any claim or demand or any person or persons as heretofore against the said land and premises accepting that of his Mother Elizabeth WEAVER's part the said John WEAVER his Heirs and assigns shall yield and pay to her yearly and every year during her natural life agreeable to her share of the said land and premises. The "promised land" was expanding westward with the completion of the Lancaster Road. The lure of cheap farm land and the availability of Conestoga wagons provided the impetus to move the Weber family IIO miles west to Sleepy Creek, Berkeley County, Colony of Virginia. With this new start and the
similar sound and confusion of the two names, it must have seemed natural to change the family name from Weber to Weaver. After all, for the most part, colonists were British and English speaking. With the onset of the Revolutionary War, Berkeley County would quickly feel immediate and profound effects. As early as 1777, soldiers from the Berkeley County militia were involved in the Battle of Brandywine, Pennsylvania. In that battle, George Washington tried to prevent General William Howe from taking Philadelphia. It was a British victory with the outnumbered American army being driven from the field. Afterward, from 1778-1779 the militia was garrisoned at Fort McIntosh.

John Weaver enlisted in the Berkeley County Militia in 1780 and served until 1783. During his enlistment, the militia saw action at the Battle of Cowpens, South Carolina, the Siege of York and guarded British prisoners that were taken at Yorktown, all in 1781. On the homefront, Christopher Weaver had provided wheat from his farm to the Militia of Virginia. He was paid 122 Pounds Sterling and 10 shillings on October 21, 1780. It must be noted that Christopher Weaver had a total of three sons that served in the Revolutionary War. Their names were William, Christopher Jr. and John.

By 1783, Britian and the victorious Americans were negotiating peace in Paris, France. On June 18,1783, John Weaver was ordered to remain on furlough until a possible recall and was released from service. This was a way to keep soldiers bound to service in case hostilities broke out again. On September 3, 1783 the Treaty of Paris was signed and was then ratified by the Continental Congress on January 14, 1784. Thus officially ending all hostilities.

The marriage of John Weaver and Catherine Peckinpaugh occured about 1782 and was followed by the birth of their first child, John Jr., in 1783. He would be the oldest of nine children. Sadly, in 1788, the Weaver family would lose two of its patriarchs. First, Caspar Von Webber would pass away in Lancaster
County, Pennsylvania and then his son Christopher in Berkeley County, Colony of Virginia.

The will of Christopher Weaver provides an interesting insight into the inner dynamics of the Weaver family. The document stipulates an equal distribution of the estate to the seven children only upon the death of his wife, Elizabeth. Furthermore, " if John Weaver is not satisfied, (he is) to be paid (only) five shillings sterling out of the estate". This is alluding to a quarrel that would eventually cause the family to separate.

By now, the war was an event in the past and the country was being elevated with a new spirit. A combination of factors would steer National policy. The British, at the peace table in Paris in 1783, ceded the entire Northwest Territories to the United States. The U. S. Congress created the Virginia Military District of Ohio, which was reserved for Virginia's Revolutionary War soldiers. According to an act of Virginia in 1779, the number of acres granted varied according to rank and years of service of the recipient. For instance, a Major General was entitled to 15,000 acres and a soldier serving three years could receive 100 acres. In 1800, John Weaver received 100 acres for his service in the Berkeley County militia.

After the death of their mother Elizabeth, the Weaver family quickly became part of the westward migration. Brothers Henry, Christopher Jr. and William left Berkeley County to Kentucky and eventually arrived in Champaign County, Ohio in 1802. John Weaver's oldest son John Jr. married Christianna Miller in Berkeley County, in 1806 and immigrated to Clermont County, Ohio in 1807. Upon arrival, he rented a farm from Ezekial Dimmitt near Batavia. By letter, his glowing accounts induced his father, John, to follow. By 1810, John left Virginia with all seven of his unmarried children and made their way to Clermont County, Ohio. John Weaver brought with him considerable means, stock and farming implements. He was prepared to make a new life for his family. Between 1812 and 1827, John purchased over 805 acres of land. His first house was a log cabin. Later a wooden structure, and then a brick-style house was built on the farm. He even built a windmill on his land.

In 1829, John's wife Catherine would pass away. John died two vears later, and they are both buried together on their original farm property, The Weaver Burial Ground, located on the Wiseman Property on Elklick Road, two and a half miles south of Batavia, Ohio on State Route 222. After John's death,
Congress libered the service pension acts benefitting Revolutionary War veterans and in 1833, the heirs of John Weaver received a land grant from President Andrew Jackson for 682 acres. To this day, members of the Weaver family still occupy land once owned by John Weaver, Revolutionary War veteran.

Mary married Johann Baltzer Wollam son of Jacob Wollam Elder and Maria Magdalena Bashaar. Johann was born on 22 Nov 1745 in , Berkeley, Wv. He died on 22 Nov 1823 in Calcutta, St. Clair Twp, Columbiana, Oh. He was buried in Wollam Farm, St.Clair Twp, Columbiana, Oh.

Johann Baltzar Woolam (His name is spelled Balser in his father's will) was born Nov. 24, 1745 in Lancaster Co., PA. He married Mary Magdalene Weaver and moved to Fredricks Co., VA where their children were born. A lease of a track of land by Baltzar was recorded Sept. 29, 1781 in Berkeley County in the Commonwealth of Virginia. (See copy included) His name is spelled Baltzer Wollam in the lease and in many family writings. Baltzar was a veteran of the Revolutionary War. He moved to Calcutta, Ohio in the Spring of 1804 and died November 22, 1823 in Columbiana County, Ohio.

This indenture on the 3rd day of May in the year of our Lord one thousand seven hundred and eighty-one between the right honorable Thomas Fairfax Baron of Cameron in that part of Great Britain and Scotland and proprietor of the northern neck of Virginia of the one part and Baltzer Woolam of Berkeley Co. in the commonwealth of Virginia of the other part, witnesseth that the said Lord Fairfax for and in consideration of the rent hereinafter named and covenants herein contained, hath granted, demised, and to farm, let and together these presents doth grant and devise and to farm let to the said Baltzer Woolam his executors and administrators and assigns, a certain tract of land lying in the said Co. of Berkeley, about a mile and three quarters from the river Potomac joining the lands of Thomas Adams, Colonel John Carlyle, Michael Shively and the lots of his Lordship's manor land in the said county and described as follows: Beginning at a locust post near some trees and running from thence along Adams' line south 60o 33 poles to a point near a very large black oak, on a treaty line of John Carlyle, North 60o East 102 poles to four white oaks on Howard Corner, Thence to Shivelys, thence along treaty line North 42o East 142 poles to Spanish oaks and a black ash and white oaks at Shively's corner and Barnerd Barpaine's line thence to John Barnerd Franks and Capt. Stephens thence to the place of beginning containing three hundred and twenty acres. To have and to hold the said Plantation or track of land above mentioned appurtenances, the said Baltzer Woolam during the term of twenty-one years from the date of these presents, fully to be completed and ended yielding and paying therefore to the said Lord Fairfax his heirs and assigns the rent six pounds sterling money of Great Britain on Michaelmas day next, and the like sum of six pounds sterling money yearly and every year on Michaelmas day during the said time and also paying all taxes and appointments which shall be payable to the Right Honorable Lord Fairfax for himself, and his heirs doth covenant, and grant to the said Baltzer woolam, his heirs, administrators and assigned shall and may peacefully and quietly have, hold and occupy, possess and enjoy the grant of land above mentioned during all the said term of twenty-one years subject only to the rent above reserved and to the payment of the taxes above specified and the said Baltzer Woolam for himself and his heirs doth covenant and grant to
and with the said Lord Fairfax his heirs and assigns that he the said Baltzer Woolam his heirs, executors shall and will from time to time and at all times during the said time of twenty-one years will and hereby pay Lord Fairfax the above-named rent six pounds sterling on Michaelmas day yearly and every year will also pay or cause to be paid to the Sheriffs or other constables authorized to reassure the same all taxes and assessments which shall be payable to government and at expiration of said time shall yield peacefully and quietly the occupation of said land.

"Possible date of birth, New Holland, Earl Twp, York Co, PA. Baltzer traced his ancestry back to the French Huguenots, who on account of their religious views, were driven from their native land, and sought homes somewhere on the upper waters of the Rhine River, on the banks of a small stream called Ulm. Today the city Ulm is in southwest Germany in the Province of Wurttenberg, on the border with Bayern. The Ulm River is on the Donau River. The Iller River joins the Donau, south of the city of Ulm. Here they were also persecuted and in order to enjoy greater religious liberty, they embarked for America, landing at Philadelphia about 1700.
The residents of the Ulm and Rhine Valley were hard-working, thrifty people. They were tired of the constant war, so in 1683 when William Penn offered the Colony of Pennsylvania for all people, these Germans of the Rhine Valley were ready for an exodus. Nearly all of those who left Germany sailed from Rotterdam, Holland, to Philadelphia. These Germans were called "Pennsylvania Dutch".

10 Mar 1785 purchased 296 acres from Mathias Swim. (Mathias Swim and Christopher Weaver, the father of Mary Magdalene Weaver, were mentioned as living on Sleepy Creek, Berkeley Co, Va, where they gave patriotic service during the Revolutionary War.)
Before 1790, brothers Shem and Peter migrtated to the 'Ten Mile Country' in the area that is now Greene Co, PA.
15 Apr 1794 purchased 184 acres and 103 acres from John Bailey, Jr.
1801/1806, sold these tracts in parcels from 1801 thru 20 Sep 1806.
After 1806 moved to Columbiana Co, OH
22 Nov 1823, The Wollam Cemetery is located in Section 15 of St. Clair Township .5 mile north of the intersection of State Route 170 and the Old Fredericktown Road. There are no stones to be found."

7. William Weaver (Christopher ) was born on 24 Dec 1759 in Bucks Co, Pa. He died on 8 Jun 1836 in Mad River Twp, Champaign Co, Oh. He was buried in Terre Haute, Mad River Twp, Champaign Co, Oh.

Was in the Rev. War. as a private in the Virginia Militia, Pension #S-17770, and wa an eyewitness to Cornwallis' march from Yorktown. William served under Captains Jacob Linder and John Stevens. Removed to Mason Co, KY in 1792 and in 1802 they emigrated to Ohio. They settled in what is now known as Clark Co, OH, were they rented from William Chapman eighty acres of land, a part of which was prairie land. Here they lived for five years when they moved to Section 13 in Tremont, Champaign Co, OH. They resided there until their deaths and left that land to a son, William Weaver, Jr. Member of T.H. Methodist Episcopal Church.

At any rate, Nancy Chapman, daughter of William Chapman of Champaign County, Ohio married Henry Weaver, the grandson of Christopher Weaver (senior) of Berkeley County. I have proof that this William as well as Nancy and Henry are my grandparents. Are the two William Chapmans one and the same????

To all to whom this present writing shall come sends Greeting:
Know ye that for good for & in consideration of the Compensation to me paid & for the annual rent herein after reserved, I have given, granted & confirm unto William Chapman of Berkeley County apignee1 of Geo. Chapman, a certain tract of waste & ungranted Land on each side of Sleepy Creek in the said County bounded as by a ( ) thereof made by Richard Rigg. Provided that if the said Wm Chapman his heirs and apigns1 shall not pay the said reserved annual rent as aforesaid, so that the same or any parts thereof shall be behind & unpaid by the space of 2 whole years after the same shall become due. If legally demanded that then it shall & may be lawful for me, my heirs or apigns 1 - Proprietors as aforesaid, may or their certain attorney or attornies agent or agents unto the above Granted
premises to reenter & hold the same so as if this Grant had never passed."

In Rev. War. Christopher Weaver, with his brother-in-law, Charles Rector, settled at the mouth of Storms Cree, near what is now known as Tremond, Clark County, Ohio in 1801. He came to Ohio by way of Pennsylvania, Virginia and Kentucky.
